These Terms of Use are an agreement between you and Log Mc. By downloading, subscribing to, or using Log Mc, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the app.
Log Mc is a heavy-vehicle fatigue-management assistant and calculator. It is not a certified Electronic Work Diary (EWD), not an official system of record, and not proof of compliance. It does not replace your written National Driver Work Diary, which you must continue to keep as required by law. Final responsibility for complying with the Heavy Vehicle National Law (HVNL) fatigue rules — or the Western Australian equivalents — rests with you (the driver) and your operator at all times.
1. Agreement to these terms
These Terms of Use are an agreement between you and the provider of Log Mc. By downloading, subscribing to, or using Log Mc, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the app.
2. Log Mc is an assistant, not a regulator
Log Mc is a heavy-vehicle fatigue-management assistant and calculator. It is not a certified Electronic Work Diary (EWD), an official system of record, or proof of compliance. It does not replace your written National Driver Work Diary, which you must continue to keep as required by law.
3. Your responsibility
Final responsibility for complying with the Heavy Vehicle National Law (HVNL) fatigue rules — or the Western Australian equivalents — rests with you (the driver) and your operator at all times. Log Mc is a tool to assist you; it does not replace your written diary, your professional judgement, your operator’s systems, or qualified legal advice.
4. Accuracy of information
Log Mc’s calculations and warnings are only as accurate as the work and rest you record, and how promptly you record it. We work hard to make Log Mc accurate, but we do not warrant that it is correct or complete in every situation. Do not rely on Log Mc alone to avoid a breach, penalty or fine.
5. Not legal advice
Information shown in Log Mc is general in nature and is not legal advice. For advice about your specific circumstances, consult a qualified adviser or the National Heavy Vehicle Regulator (NHVR).
6. Price
Log Mc is currently free to use. We may introduce paid features in future. If we do, we will show the price and terms clearly before you are charged, and any subscription would be billed through your Apple ID and renew automatically until cancelled.
7. Promotional & offer codes
If we offer promotional or discount codes in future, they will be subject to their own conditions, eligibility and expiry, and to Apple’s redemption rules. Codes have no cash value, cannot be combined unless we say so, and may be withdrawn at any time.
8. Purchases & refunds
If you buy anything through the app in future, payments are processed by Apple through your Apple ID, and refund requests are handled by Apple under their policies. Nothing in these terms limits any refund or other right you have under the Australian Consumer Law (see section 11).
9. Where Log Mc can be used
Log Mc is intended for use in Australia only. It supports HVNL jurisdictions (NSW, VIC, QLD, SA, ACT and TAS) and Western Australia under its separate regime. The Northern Territory is not currently supported.
10. Your data & privacy
We collect and handle your information as described in our Privacy Policy. Your logbook data is stored on your device and synced to your own private iCloud account. Please read the Privacy Policy for full details.
11. Your Australian Consumer Law rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under that law where it cannot lawfully be excluded.
12. Limitation of liability
Subject to your rights in section 11, Log Mc is provided “as is” and “as available”. To the maximum extent permitted by law, we are not liable for any loss, fine, penalty, demerit, damage or claim arising from your use of, or reliance on, Log Mc — including any breach of fatigue or work-diary laws. Where our liability cannot be excluded but can be limited, it is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.
13. Changes
We may update Log Mc and these terms from time to time. Where changes are material we will take reasonable steps to let you know. Continuing to use Log Mc after a change means you accept the updated terms.
14. Governing law & contact
